Arkansas law requires real estate agents to disclose which party or parties they represent in a transaction. Understanding that relationship helps you know whose interests the agent is obligated to protect and promote.

How agency representation works.

This overview is educational. Your written agency agreement and transaction documents control the actual relationship.

Seller Representation

A listing or seller’s agent represents the seller. The agent’s primary duty is to protect and promote the seller’s interests and to share material information with the seller.

B

Buyer Representation

A buyer’s agent represents the buyer. The agent’s primary duty is to protect and promote the buyer’s interests and to share material information with the buyer.

D

Dual Agency

Dual agency occurs when an agent or agents within the same firm represent both buyer and seller. Both parties must give written consent, and the agent’s duties are limited by the written agreements.

A practical confidentiality reminder: If an agent does not represent you, do not share information that could weaken your negotiating position—such as your highest price, lowest acceptable price, motivations, strategy or financial situation.
